App Terms of Service – Ballie for Business

These App Terms of Service (the “App Terms” or “EULA”) govern your use of the Ballie for Business mobile application (the “App”) provided by Ballie Live (“we”, “us”, “our”). By downloading, installing, accessing or using the App, you agree to be bound by these App Terms. If you do not agree, do not use the App.
These App Terms apply specifically to the App and supplement our Privacy Policy.
1. Eligibility and account
You must be at least 13 years old to create an account. Users under 16 need verifiable consent from a parent or legal guardian where required by law. You are responsible for the accuracy of your account information and for all activity that occurs under your account.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install and use the App on any Apple-branded or Android device that you own or control, solely for your business and professional use, in accordance with these App Terms and the usage rules of the applicable app store.
3. User-Generated Content and community features
The App allows you to create a business profile, submit content, participate in directory listings and leaderboards, and interact with other users (collectively, “User Content”). You retain ownership of your User Content but grant Ballie Live a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display and distribute your User Content within the App and our services.
4. Zero-tolerance policy for objectionable content and abusive behavior
We have a zero-tolerance policy for objectionable content and abusive behavior. The following is strictly prohibited and will result in immediate removal of the content and suspension or permanent termination of the account responsible:
- Hate speech, discrimination or harassment based on race, ethnicity, religion, nationality, gender, sexual orientation, disability or any other protected characteristic
- Sexually explicit, pornographic or sexually suggestive content
- Threats, intimidation, bullying or stalking of any user
- Violent, gory or graphic content
- Content that promotes self-harm, suicide or eating disorders
- Illegal activity, including the sale or promotion of drugs, weapons or stolen goods
- Spam, scams, phishing or fraudulent activity
- Impersonation of any person, organization or Ballie Live staff
- Sharing personal information of others without consent (doxxing)
- Cheating, exploits or unauthorized automation in games and leaderboards
- Misleading business listings, fake reviews or deceptive promotional content
- Any content that violates applicable law or third-party rights
5. Reporting and blocking abusive users
The App provides tools that allow you to:
- Report any User Content, profile, message or behavior you believe violates these App Terms by tapping the “Report” option available next to the relevant content or profile
- Block any user, which prevents them from contacting you, viewing your profile or interacting with your content
- Mute users to hide their content from your feed
You can also report abuse directly by emailing info@ballielive.nl with the subject line “Report”.
6. Our review and removal commitment
We commit to:
- Reviewing every report within 24 hours of receipt
- Removing offending content and, where appropriate, suspending or permanently banning the user responsible
- Notifying the reporter of the action taken where this is technically and legally possible
- Cooperating with law enforcement in cases involving illegal content or threats of harm
We reserve the right to remove any content and to suspend or terminate any account at our sole discretion, with or without notice, where we believe these App Terms or applicable law have been violated.
7. Prohibited use
You agree not to:
- Use the App for any unlawful purpose
- Reverse engineer, decompile or disassemble the App
- Attempt to gain unauthorized access to any part of the App or our servers
- Interfere with or disrupt the integrity or performance of the App
- Use any automated means (bots, scrapers, scripts) to access the App
- Resell, sublicense or transfer your account or access to the App
8. In-app purchases and subscriptions
The App may offer in-app purchases, subscriptions and virtual currency. All purchases are final and non-refundable except where required by law or by the policies of the relevant app store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period through your app store account settings.
9. Privacy
Your use of the App is also governed by our Privacy Policy. Please read it carefully.
10. Third-party services and app stores
The App is distributed through the Apple App Store and Google Play Store. Your use of the App is also subject to the terms of service of these stores. You acknowledge that:
- Apple Inc. and Google LLC are not parties to these App Terms
- Apple and Google have no obligation to provide maintenance or support for the App
- In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App
- Apple and Google are third-party beneficiaries of these App Terms and have the right to enforce them against you
11. Disclaimer of warranties
The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. To the maximum extent permitted by law, Ballie Live disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy.
12. Limitation of liability
To the maximum extent permitted by law, Ballie Live shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, arising from your use of the App. Our total aggregate liability shall not exceed the amount you paid to use the App in the twelve months preceding the claim, or EUR 50, whichever is greater.
13. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including breach of these App Terms. You may stop using the App and delete your account at any time from within the App settings. If you no longer have access to the App, you may request the deletion of your account and all associated data by emailing info@ballielive.nl. Provisions that by their nature should survive termination will do so.
14. Changes to these App Terms
We may update these App Terms from time to time. Material changes will be communicated via the App or by email. Continued use of the App after changes take effect constitutes acceptance of the updated App Terms.
15. Governing law and disputes
These App Terms are governed by the laws of the Netherlands. Any disputes arising from or relating to these App Terms or the App shall be submitted to the competent court in the Netherlands, without prejudice to mandatory consumer protection rules in your country of residence.
